Terms and conditions

These terms and conditions together with the Web User Conditions and Privacy Policy are the Terms and Conditions of business and form the agreement between Salons & Spas Etc and the Client.  By clicking to accept the terms and conditions the Client agrees that all transactions carried out between Salons & Spas Etc and the Client shall be in accordance with and subject to the Terms and Conditions.

1.   Interpretation

In the Terms and Conditions:

“Booking” means the booking of an appointment for services to be provided by the Member to the Client.

“Client” means you the client or customer of Salons & Spas Etc.

“Gift Vouchers” means the gift vouchers of Salons & Spas Etc or the Members which shall be redeemed through the Member as tender for payment of goods and/or services. “Member” means the Members of the Directory of Salons & Spas Etc from time to time.

“Salons & Spas Etc ” means Make Me Shine (UK) Limited which as Salons & Spas Etc from York Eco Business Centre, Amy Johnson Way, York, YO30 4AG

“Product” means the products of the Members offered for sale via the Website from time to time.

“Website” means www.salonsandspasetc.com

2.   Services

(a) Gift Vouchers

Clients may purchase Salons & Spas Etc Gift Vouchers and cards which may be used at participating Salons & Spas Etc Member salons only.  Clients may also purchase Gift Vouchers of Members which may be used at the member salon only.  Prior to booking an appointment with a Member, it is the responsibility of the Client to confirm that the salon is a Member and participates in the Salons & Spas Etc Voucher Scheme and to provide the Gift Voucher number at the time of Booking.

As payment is collected at the time of booking, for the purposes of the paragraph(s) in these terms and conditions concerning refunds of a confirmed Booking shall be considered a redemption of a voucher so that once booked you are not entitled to a refund if the appointment cannot be kept by you and any refund shall be at the discretion of the Member.

The total value of the Gift Voucher can be redeemed at a single salon.  Change cannot be given in cash and the Member will provide a credit note for any unused portion.  Gift Vouchers can be exchanged for goods or services of face value or a higher price on payment of the difference.  

Gift Vouchers are only valid if in their original and unaltered state.  Gift Vouchers are not replaceable if lost, stolen, destroyed or expired.  Gift Vouchers are valuable and should be stored in a safe place.

Salons & Spas Etc is not responsible for loss, theft, damage or unauthorised use of Gift Vouchers, they cannot be replaced.

Gift Vouchers expire 24 months from the date of purchase.

Clients shall have the right to return any Gift Voucher to Salons & Spas Etc within 7 days of original receipt for a full refund.  Salons & Spas Etc is unable, however, to process returns or reimburse any payment transactions for a Gift Voucher outside of this period.  Please also note that once an appointment has been made with a Member Salon the Client is bound by the terms and conditions of the Member.  Salons & Spas Etc will refund the amount paid for the returned Gift Voucher and all refunds will be made to the person who purchased the voucher and the monies will be refunded directly to the credit/debit card used for the purchase.  All refunds will be paid within 30 days of notification of cancellation and receipt of the original Gift Voucher.  To request a refund you must return the Gift Card or Voucher by recorded delivery to Salons & Spas Etc, York Eco Business Centre, Amy Johnson Way, York, YO30 4AG, along with a letter detailing the reason for your refund request.

(b)  Products

Salons & Spas Etc offers for sale Products of participating Members.  v will accept orders to purchase Products of Members by Clients, as agent for the Member.  Any contract for sale shall be between the Client and the Member on such terms and conditions as the Member issues have from time to time.

By accepting these terms and conditions you accept the terms and conditions of the Member as applicable.

Salons & Spas Etc does not hold a stock of Products on behalf of Members and has no control over the Products for sale.  When an order is placed on the Website this shall be deemed an offer by the Client to purchase a Product, which offer shall be accepted by the Member by e-mail notification directly to the Client.  A contract for sale will be formed between the Client and the Member in respect of the goods and/or services detailed in the e-mail notification immediately upon receipt of it.  

(C)   Bookings

Clients may make Bookings for services provided by Members by using the online booking management system on the Website.

All services provided by Members shall be subject to the terms and conditions of the Member and Clients should ensure that they are familiar with such terms and conditions including but not limited to provisions for cancellation of Bookings.

3.   Payment

Clients shall provide payment details enabling payment to be taken in full at the time of an order for Products or Gift Vouchers or making a Booking being confirmed.  Payment may be made by debit or credit card using a secure online payment gateway.  

All prices shown are in pounds sterling and are inclusive of VAT.

Salons & Spas Etc may, at its discretion, refuse to process a transaction and in such event the Client will be notified of such refusal.

Any Product offered for sale on the Website which is to be delivered overseas may incur import duties on delivery which shall be payable by the Client in addition to the purchase price.

4.   Delivery

Gift Vouchers ordered via the Website will be delivered to the Client by Salons & Spas Etc within 7 days of receipt of the order.

Products purchased via the Website will be supplied to the Client by the Member and any costs of postage and packaging charged by the Member will be that amount as notified by the Member to the Client.  

The time and date for delivery shall be as agreed between the Client and the Member.

5.   Risk and Title

Risk in the Products shall pass to the Client on delivery.

Title in the Products shall subject to payment being received in full being received, pass on despatch unless the Member terms state otherwise.  

6.   Cancellation and Returns

The sale of Products and Gift Vouchers via the Website are subject to the Consumer Protection (Distance Selling) Regulations 2000 (“DSR”) in accordance with which the Client has a right to cancel orders placed (subject to the exemptions set out below) within 7 days of delivery and to receive a refund of the purchase price paid.

Any Client wishing to return Products bought via the Website which are returnable must notify the Member in writing of their wish to cancel the agreement and must ensure that all reasonable care is taken of the Products or Gift Vouchers both before or during transit when returning the Product.

Clients shall be entitled to receive a full refund of the purchase price including any cost of return. This will be organised by the Member and be paid by Salons & Spas Etc.

There are exceptions to the right to return which include:

•    items which are perishable including food and flowers,

•    personal items and cosmetics,

•    items which are made to a Client’s specification or are personalised in any way.

7.   Liability and Disclaimer

Salons & Spas Etc gives no undertaking, representation or warranty as to the Products, Gift Vouchers, Bookings, nor that the goods or services provided by the Member to the Client will be of satisfactory quality, shall match the description or are fit for purpose and any such warranties are disclaimed.

Salons & Spas Etc shall have no liability to the Client in respect of any loss or damage whether direct, indirect or consequential in respect of loss or damage suffered as a result of a Booking or cancelled Booking, non availability of a Product howsoever caused except for liability for death or personal injury of a Client arising from the negligence of Salons & Spas Etc.  All and any liability is hereby otherwise disclaimed.

8.   Miscellaneous

These Terms and Conditions contain all of the terms of agreement between the Member and the Client and shall supersede all previous agreements or arrangements between them.

If any part of these Terms and Conditions is found to be unenforceable (including any provision in which liability is excluded) the enforceability of any other part of the Terms and Conditions will not be affected.

These Terms and Conditions shall be governed and interpreted in accordance with the laws of England and the Member and the Client irrevocably submit to the exclusive jurisdiction of the English Courts.

For the purpose of the Contracts (Rights of Third Parties) Act 1999 these Terms and Conditions are not intended and will not give any person who is not a party to it any right to enforce any of the provisions of these Terms of Conditions.
